Terms of Service

1. Acceptance of Terms

By accessing or using StudioMCPHub (the "Service"), whether directly or through an AI agent, automated system, or programmatic client, you agree to these Terms. "You" means the individual or entity that owns or controls the wallet address or account used to access the Service.

If you operate an AI agent that uses this Service, you (the operator) are responsible for the agent's actions and compliance with these Terms.

Using the API constitutes acceptance. No clickwrap required.

2. Service Description

StudioMCPHub is a Model Context Protocol (MCP) server providing AI-powered creative tools and art dataset access. Available tools include: image upscaling, metadata enrichment, metadata infusion, hash registration, provenance verification, image utilities, compliance manifests, and museum art dataset queries.

The Service is designed for both human users and autonomous AI agents.

3. Eligibility

You must be 18+ or the age of majority in your jurisdiction
You must not be located in a country subject to US sanctions (OFAC restricted countries)
You must not be on any US government restricted parties list
Entities must be legally formed and in good standing

4. Payment Terms

4a. Payment Methods

Stripe: Traditional card payments for credit purchases and per-call payments
GCX Credits: Pre-purchased credits at published rates

4b. Pricing

Current pricing published at /pricing and in the MCP server's tool schemas
Prices may change with 14 days notice (posted on website and in API response headers)
Volume discounts applied automatically per wallet based on 30-day rolling spend

4c. Refunds

All tool calls are non-refundable once execution begins
Failed tool calls (server error, not user error) will not be charged, or credits will be refunded
GCX credit purchases are non-refundable except where required by law
Unused GCX credits do not expire

4d. Taxes

Prices are exclusive of taxes. You are responsible for applicable taxes in your jurisdiction.

5. GCX Credits

            GCX credits are a prepaid service credit, NOT a cryptocurrency, security, or financial instrument. Credits are non-transferable between wallets/accounts. Credits have no cash redemption value.
        

We reserve the right to adjust credit exchange rates for future purchases (existing balances are not affected).

6. Loyalty Rewards

5% credit-back on paid tool calls (not on loyalty redemptions)
Loyalty credits are non-transferable and have no cash value
We may modify or discontinue the loyalty program with 30 days notice

7. Acceptable Use

You agree NOT to:

Use the Service to generate illegal content (CSAM, weapons instructions, etc.)
Generate content that infringes third-party intellectual property rights
Attempt to reverse-engineer, extract model weights, or replicate our backend services
Circumvent payment requirements or rate limits
Use the Service for money laundering or sanctions evasion
Submit malicious payloads, prompt injections targeting our backend models, or denial-of-service attacks
Resell Service access without written agreement
Misrepresent AI-generated content as human-created in contexts where disclosure is legally required
Register provenance, hashes, or metadata for works you do not own or have authorization to represent
Use provenance tools to create false attribution, fabricate ownership claims, or misrepresent the origin of any creative work

8. Provenance Integrity

8a. Registration Is Not Proof of Ownership

            Hash registration and metadata infusion record when a fingerprint was registered and by whom. They do NOT constitute proof of authorship, copyright ownership, or legal title. Registration creates a timestamped record, not a legal claim.
        

8b. Your Representations

By using register_hash, infuse_metadata, or any provenance tool, you represent and warrant that:

You are the creator or authorized representative of the work
You have the legal right to register provenance for the work
The metadata you provide (artist name, title, copyright holder) is accurate and not misleading
You are not attempting to claim provenance over a work created by someone else

8c. Fraudulent Registration

We reserve the right to:

Investigate suspected fraudulent provenance registrations
Flag, annotate, or remove registrations found to be fraudulent
Cooperate with legitimate rights holders who dispute a registration
Suspend or terminate accounts engaged in provenance fraud
Report fraudulent activity to law enforcement where appropriate

If you believe someone has fraudulently registered provenance for your work, contact legal@metavolve.com with evidence of your ownership.

8d. Dispute Resolution for Provenance Claims

In the event of conflicting provenance registrations, we will consider: timestamp priority (earlier registration), evidence of original creation, copyright registration, and any other relevant documentation. We are not an arbiter of ownership disputes and may refer parties to appropriate legal channels.

9. Intellectual Property

9a. Tool Outputs

You own the outputs produced by our tools (upscaled images, metadata, etc.), subject to third-party content rights and source material licenses.

9b. Dataset Content (Alexandria Aeternum)

Museum artwork images and metadata are provided under their respective institutional licenses. Per-artwork license information is included in the compliance_manifest tool response. You are responsible for complying with source licenses.

9c. Our IP

The StudioMCPHub service, API design, Golden Codex schema, and enrichment models are proprietary. Tool schemas are provided for integration purposes only.

10. Service Level & Availability

The Service is provided "as is" with no uptime guarantees
We target 99.5% availability but do not guarantee it
GPU-dependent tools (upscaling) may have cold start delays of 30-120 seconds
We may rate-limit or throttle access to maintain service quality

11. Data & Content Handling

            Uploaded images are processed in memory and NOT permanently stored unless you explicitly use storage tools. We do not use your inputs or outputs to train AI models.

12. Wallet Security

You are solely responsible for the security of your wallet address. We use wallet addresses as account identifiers only. We will never ask for your private keys or seed phrases.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

WE ARE NOT LIABLE FOR: LOST PROFITS, DATA LOSS, INDIRECT/CONSEQUENTIAL DAMAGES, OR THIRD-PARTY SERVICE FAILURES.

14. Indemnification

You indemnify us against claims arising from: your use of generated content, your violation of these Terms, your violation of applicable law, or content you submit.

15. DMCA / Copyright

If you believe content accessible via our dataset tools infringes your copyright, submit a DMCA notice to legal@metavolve.com. We will respond to valid takedown requests within 10 business days.

16. Sanctions & Export Compliance

The Service complies with US export controls and OFAC sanctions. We may block wallet addresses associated with sanctioned entities.

17. Termination

We may suspend or terminate access for violation of these Terms, non-payment, or legal requirement
Upon termination, unused GCX credits are forfeited unless required otherwise by law
Sections on IP, liability, indemnification, and dispute resolution survive termination

18. Dispute Resolution

Governed by the laws of the State of California, USA
Disputes resolved by binding arbitration (JAMS) in San Francisco, California
Class action waiver: disputes must be brought individually
Small claims court exception for claims under $10,000

19. Modifications

We may update these Terms with 30 days notice. Continued use after the effective date constitutes acceptance. Material changes announced via API headers and website.
